Before his appointment Lord Fleming held the office of Solicitor-General for Scotland in the last and present Conservative Governments. Lord Fleming had a distinguished career in both law and politics in Scotland.

  • Solicitor-General for Scotland: He served in this role twice, from 1922 to 1923 and again from 1924 to 1926, under Conservative (Unionist) governments.
  • Member of Parliament: He was the Unionist MP for Dunbartonshire from 1924 until his appointment to the bench in 1926.
  • Scottish Judge: He was appointed as a Senator of the College of Justice in December 1925, taking the judicial title "Lord Fleming".
  • The Fleming Report (1944): Late in his career, he chaired a notable committee that produced the "Fleming Report," which influenced the Education Act of 1944 and defined the relationship between state funding and public schools
  • He married Beatrice Joan Swan (1880–1965) on September 4, 1913, in North Berwick. Beatrice was the daughter of John Swan, who was a well-known livestock agent in Edinburgh. David Pinkerton Fleming (Lord Fleming) and his wife, Beatrice Joan Swan, had at least one child.
  • Anne Fleming: She was born around 1914. Historical records and newspaper archives from the time mention her as their daughter
